Article 28: Authority to use free of charge

Part Six: Use Free of Charge, Payment of Expenses and Transfer of Immovable Property between Administrations › Chapter One: Use Free of Charge and Expenses

The Ministry of National Defence is authorised to use, without being subject to any duty or charge, lime, stone and sand quarries deemed necessary for national defence construction and installations that are not under the ownership and disposal of natural persons and legal persons of private law or under their usufruct by virtue of a licence.

The Ministries of Public Works and of Village Affairs and Cooperatives, as well as the General Directorate of the Turkish State Railways, the General Directorate of Highways and the General Directorate of State Hydraulic Works, may likewise, for the same reasons and under the same conditions, use without being subject to any duty or charge the lime, stone and sand quarries in all directions of the railway line, highway or water facilities that are not under the ownership and disposal of natural persons and legal persons of private law or under their usufruct by virtue of a licence.

MADDE 28 · Bedelsiz kullanma yetkisi

Milli savunma inşaat ve tesisatı için gerekli görülen gerçek ve özel hukuk tüzelkişilerinin mülkiyet ve tasarrufunda veya ruhsatname ile intifaları altında bulunmayan kireç, taş ve kum ocaklarını, hiç bir resim ve ücrete tabi olmadan kullanmaya Milli Savunma Bakanlığı yetkilidir.

Bayındırlık, Köy İşleri ve Kooperatifler bakanlıkları ile T.C. Devlet Demiryolları İşletmesi Genel Müdürlüğü, Karayolları Genel Müdürlüğü ve Devlet Su İşleri Genel Müdürlüğü de aynı sebep ve şartlarla, demiryolu hattının veya karayolunun veya su tesislerinin her yönündeki, gerçek ve özel hukuk tüzelkişilerinin mülkiyet ve tasarrufunda veya ruhsatname ile intifaları altında bulunmayan kireç, taş ve kum ocaklarını hiç bir resim ve ücrete tabi olmadan kullanabilirler.
