Article 308: IV. Consent and age of the minor

Book Two: FAMILY LAW › Part Two: KINSHIP › Chapter One: ESTABLISHMENT OF DESCENT › Division Four: ADOPTION A. Adoption of minors

The adoptee must be at least eighteen years younger than the adopter.

A minor who has the capacity of discernment may not be adopted without his or her consent.

A minor under guardianship may be adopted with the permission of the guardianship authorities, irrespective of whether he or she has the capacity of discernment.

MADDE 308 · IV. Küçüğün rızası ve yaşı

Evlât edinilenin, evlât edinenden en az onsekiz yaş küçük olması şarttır.

Ayırt etme gücüne sahip olan küçük, rızası olmadıkça evlât edinilemez.

Vesayet altındaki küçük, ayırt etme gücüne sahip olup olmadığına bakılmaksızın vesayet dairelerinin izniyle evlât edinilebilir.
