Article 605: B. Issuing debt instruments and voluntary payment

Part Two: Special Obligational Relationships › Chapter Sixteen: Gambling and Betting

Even if an ordinary promissory note or a bill of exchange signed by a person who gambles or bets has been transferred to a third party, no one may bring an action or initiate enforcement proceedings on the basis thereof. The rights conferred by negotiable instruments on third parties acting in good faith are reserved.

Payments voluntarily made for a gambling or betting debt may not be reclaimed. However, if the proper conduct of the game or bet was prevented by an unforeseen event or by an act of the other party, or if the other party introduced fraud into the game or bet, the payment voluntarily made may be reclaimed.

MADDE 605 · B. Borç senedi verme ve isteyerek ödeme

Kumar oynayan veya bahse giren kişi tarafından imzalanmış adi borç veya kambiyo senedi üçüncü bir kişiye devredilmiş olsa bile, hiçbir kimse bunlara dayanarak dava açamaz ve takip yapamaz. Kıymetli evrakın iyiniyetli üçüncü kişilere sağladığı haklar saklıdır.

Kumar ve bahis borcu için isteyerek yapılan ödemeler geri alınamaz. Ancak, kumar veya bahsin usulüne göre yürütülmesi beklenmedik olayla veya diğer tarafın fiiliyle engellenmişse ya da diğer taraf kumar veya bahse hile karıştırmışsa, isteyerek yapılan ödeme geri alınabilir.
