Where the Code confers discretion on the judge or directs the judge to take into account the circumstances or just cause, the judge shall decide in accordance with law and equity.

MADDE 4 · III. Hâkimin takdir yetkisi
Kanunun takdir yetkisi tanıdığı veya durumun gereklerini ya da haklı sebepleri göz önünde tutmayı emrettiği konularda hâkim, hukuka ve hakkaniyete göre karar verir.
