Article 417: V. Grounds for declining guardianship

Book Two: FAMILY LAW › Part Three: GUARDIANSHIP › Chapter One: ORGANISATION OF GUARDIANSHIP › Division Four: APPOINTMENT OF THE GUARDIAN A. Conditions

The following persons may decline to accept the guardianship:

1. Those who have completed the age of sixty,

2. Those who, by reason of physical disabilities or permanent illnesses, could perform this duty only with difficulty,

3. Those who are the parents with parental authority of more than four children,

4. Those who already hold a guardianship duty,

5. The President of the Republic, members of the Grand National Assembly of Türkiye, Vice Presidents of the Republic, ministers, and members of the judicial and prosecutorial professions.

MADDE 417 · V. Vasilikten kaçınma sebepleri

Aşağıdaki kişiler vasiliği kabul etmeyebilirler:

l. Altmış yaşını doldurmuş olanlar,

2. Bedensel engelleri veya sürekli hastalıkları sebebiyle bu görevi güçlükle yapabilecek olanlar,

3. Dörtten çok çocuğun velisi olanlar,

4. Üzerinde vasilik görevi olanlar,

5. Cumhurbaşkanı, Türkiye Büyük Millet Meclisi üyeleri, Cumhurbaşkanı yardımcıları, bakanlar, hâkimlik ve savcılık mesleği mensupları.
