Article 994: b. Compensation

Book Four: LAW OF PROPERTY › Part Three: POSSESSION AND THE LAND REGISTER › Chapter One: POSSESSION A. Concept and types of possession

The good faith possessor may demand from the person claiming return that the necessary and useful expenses incurred for the thing be compensated, and may refuse to return the thing until such compensation is paid.

The good faith possessor may not demand compensation for other expenses. However, if no compensation is offered to the possessor for these expenses before the return of the thing, the possessor may, before returning the thing, separate and remove the additions which the possessor joined to the thing and which can be separated without damage.

The fruits obtained by the possessor shall be set off against the possessor's claims arising from the expenses incurred.

MADDE 994 · b. Tazminat

İyiniyetli zilyet, geri vermeyi isteyen kimseden şey için yapmış olduğu zorunlu ve yararlı giderleri tazmin etmesini isteyebilir ve bu tazminat ödeninceye kadar şeyi geri vermekten kaçınabilir.

İyiniyetli zilyet, diğer giderler için tazminat isteyemez. Ancak, şeyin geri verilmesinden önce kendisine bu giderler için bir tazminat önerilmezse, kendisi tarafından o şeyle birleştirilen ve zararsızca ayrılması mümkün bulunan eklemeleri o şeyi geri vermeden önce ayırıp alabilir.

Zilyedin elde ettiği ürünler, yaptığı giderler sebebiyle doğan alacaklarına mahsup edilir.
