Article 291: IV. Donation subject to charges

Part Two: Special Obligational Relationships › Chapter Three: Donation Contract

The donor may attach charges to the donation.

The donor may demand the performance of the charges accepted by the donee pursuant to the contract.

The right to demand performance of a charge attached to a donation in the public interest shall pass, after the death of the donor, to the relevant public authority.

If the value of the subject matter of the donation does not cover the costs of performing the charge and the excess is not paid to the donee, the donee may refuse to perform the charge.

MADDE 291 · IV. Yüklemeli bağışlama

Bağışlayan bağışlamasına yüklemeler koyabilir.

Bağışlayan, sözleşme gereğince bağışlanan tarafından kabul edilmiş olan yüklemelerin yerine getirilmesini isteyebilir.

Kamu yararına olarak bağışlamaya konulmuş olan bir yüklemenin yerine getirilmesini isteme yetkisi, bağışlayanın ölümünden sonra, ilgili kamu kurumuna geçer.

Bağışlama konusunun değeri, yüklemenin yerine getirilmesi masraflarını karşılamaz ve aşan kısım kendisine ödenmezse bağışlanan, yüklemeyi yerine getirmekten kaçınabilir.
