Article 296: II. Revocation of the promise to donate and refusal to perform

Part Two: Special Obligational Relationships › Chapter Three: Donation Contract

The person who has promised to make a gift may revoke his promise and refuse to perform it in the following circumstances:

1. If there exists one of the grounds on which he could claim the return of a thing given as a manual gift.

2. If his financial situation has subsequently changed to such an extent that performance of the promise would be extraordinarily burdensome for him.

3. If, after making the promise to donate, new family obligations have arisen for him or such obligations have become considerably heavier.

If the insolvency of the person who has promised to make a gift is established or his bankruptcy is adjudicated, the obligation to perform shall cease.

MADDE 296 · II. Bağışlama sözü vermenin geri alınması ve ifadan kaçınma

Bağışlama sözü veren, aşağıdaki durumlarda sözünü geri alabilir ve onu ifadan kaçınabilir:

1. Elden bağışlanılan bir malın geri verilmesini isteyebileceği sebeplerden biri varsa.

2. Mali durumu, sonradan sözün yerine getirilmesini kendisi için olağanüstü ağır kılacak ölçüde değişmişse.

3. Bağışlama sözü verdikten sonra, kendisi için yeni aile yükümlülükleri doğmuş veya bu yükümlülükleri önemli ölçüde ağırlaşmışsa.

Bağışlama sözü verenin borcunu ödeme güçsüzlüğü belirlenir veya iflasına karar verilirse, ifa yükümlülüğü ortadan kalkar.
