Article 390: III. Insolvency of the borrower

Part Two: Special Obligational Relationships › Chapter Five: Loan Contracts › Division Two: Loan for Consumption

If the borrower becomes insolvent after the conclusion of the loan contract, the lender may refuse to deliver the object of the loan.

The lender shall have the same right if he or she subsequently learns that the borrower had become insolvent before the conclusion of the contract.

MADDE 390 · III. Ödünç alanın ödeme güçsüzlüğü

Ödünç alan, ödünç sözleşmesinin kurulmasından sonra ödeme güçsüzlüğüne düşerse ödünç veren, ödünç konusunun tesliminden kaçınabilir.

Ödünç veren, ödünç alanın sözleşmenin kurulmasından önce ödeme güçsüzlüğüne düşmüş olduğunu daha sonra öğrenmişse, aynı hakka sahiptir.
