Article 529: I. Where the business is conducted in the principal's interest

Part Two: Special Obligational Relationships › Chapter Ten: Agency Without Authority A. Rights and obligations of the agent

Where the business was conducted in the principal's interest, the principal shall be obliged to reimburse the agent, with interest, for all expenses that were necessary and useful in the circumstances, to perform the obligations undertaken by the agent in the course of the business conducted, and to compensate the damage as assessed at the discretion of the judge. This provision shall also apply to an agent who exercised the requisite care in conducting the business, even if the expected result was not achieved.

Where the agent is unable to recover the expenses incurred, he or she shall be entitled to separate and remove the improvements in accordance with the provisions on unjust enrichment.

MADDE 529 · I. İşin işsahibinin menfaatine yapılması hâlinde

İşsahibi, işin kendi menfaatine yapılması hâlinde, işgörenin, durumun gereğine göre zorunlu ve yararlı bulunan bütün masrafları faiziyle ödemek ve gördüğü iş dolayısıyla üstlendiği edimleri ifa etmek ve hâkimin takdir edeceği zararı gidermekle yükümlüdür. Bu hüküm, umulan sonuç gerçekleşmemiş olsa bile, işi yaparken gereken özeni göstermiş olan işgören hakkında da uygulanır.

İşgören, yapmış olduğu giderleri alamadığı takdirde, sebepsiz zenginleşme hükümlerine göre ayırıp alma hakkına sahiptir.
