Article 108: Constitutive action

Part Two: Types of Action, Conditions of Action and Preliminary Objections › Chapter One: Types of Action

(1) By a constitutive action, the court is requested to create a new legal situation, or to change the content of, or to terminate, an existing legal situation.

(2) A constitutive action shall be brought in cases where a constitutive right must be exercised by way of an action.

(3) Unless otherwise provided by law, constitutive judgments shall not have retroactive effect.

MADDE 108 · İnşaî dava

(1) İnşaî dava yoluyla, mahkemeden, yeni bir hukuki durum yaratılması veya mevcut bir hukuki durumun içeriğinin değiştirilmesi yahut onun ortadan kaldırılması talep edilir.

(2) Bir inşaî hakkın, dava yoluyla kullanılmasının zorunlu olduğu hâllerde, inşaî dava açılır.

(3) Kanunlarda aksi belirtilmedikçe, inşaî hükümler, geçmişe etkili değildir.
