Article 61: Commercial advertising

Part Six: Commercial Advertising and Unfair Commercial Practices

(1) A commercial advertisement is an announcement in the nature of marketing communication made by advertisers in any medium by written, visual, auditory and similar means, in connection with trade, business, craft or a profession, for the purpose of securing the sale or rental of goods or services, or of informing or persuading the members of the target audience.

(2) As a principle, commercial advertisements shall comply with the principles determined by the Advertisement Board, general morality, public order and personality rights, and shall be truthful and honest.

(3) No commercial advertisement may be made that deceives the consumer or exploits the consumer's lack of experience and knowledge, endangers the safety of life and property, encourages acts of violence and the commission of offences, impairs public health, or exploits the sick, the elderly, children or persons with disabilities.

(4) The inclusion, for advertising purposes, in writings, news, broadcasts and programmes, without it being clearly indicated that it is an advertisement, of names, trademarks, logos or other distinctive figures or expressions relating to goods or services, or of trade names or business names, and their presentation in a promotional manner, shall be deemed covert advertising. Covert advertising by audio, written or visual means in any kind of communication medium is prohibited.

(5) Comparative advertising may be made of competing goods or services that meet the same needs or are intended for the same purpose.

(6) Advertisers shall be obliged to prove the accuracy of the claims contained in their commercial advertisements.

(7) Advertisers, advertising agencies and media service organisations shall be obliged to comply with the provisions of this article.

(8) The restrictions to be imposed on commercial advertisements and the procedures and principles to be observed in such advertisements shall be determined by regulation.

MADDE 61 · Ticari reklam

(1) Ticari reklam, ticaret, iş, zanaat veya bir meslekle bağlantılı olarak; bir mal veya hizmetin satışını ya da kiralanmasını sağlamak, hedef kitleyi oluşturanları bilgilendirmek veya ikna etmek amacıyla reklam verenler tarafından herhangi bir mecrada yazılı, görsel, işitsel ve benzeri yollarla gerçekleştirilen pazarlama iletişimi niteliğindeki duyurulardır.

(2) Ticari reklamların Reklam Kurulunca belirlenen ilkelere, genel ahlaka, kamu düzenine, kişilik haklarına uygun, doğru ve dürüst olmaları esastır.

(3) Tüketiciyi aldatıcı veya onun tecrübe ve bilgi noksanlıklarını istismar edici, can ve mal güvenliğini tehlikeye düşürücü, şiddet hareketlerini ve suç işlemeyi özendirici, kamu sağlığını bozucu, hastaları, yaşlıları, çocukları ve engellileri istismar edici ticari reklam yapılamaz.

(4) Reklam olduğu açıkça belirtilmeksizin yazı, haber, yayın ve programlarda, mal veya hizmetlere ilişkin isim, marka, logo veya diğer ayırt edici şekil veya ifadelerle ticari unvan veya işletme adlarının reklam yapmak amacıyla yer alması ve tanıtıcı mahiyette sunulması örtülü reklam olarak kabul edilir. Her türlü iletişim aracında sesli, yazılı ve görsel olarak örtülü reklam yapılması yasaktır.

(5) Aynı ihtiyaçları karşılayan ya da aynı amaca yönelik rakip mal veya hizmetlerin karşılaştırmalı reklamı yapılabilir.

(6) Reklam verenler ticari reklamlarında yer alan iddiaların doğruluğunu ispatla yükümlüdür.

(7) Reklam verenler, reklam ajansları ve mecra kuruluşları bu madde hükümlerine uymakla yükümlüdür.

(8) Ticari reklamlara ilişkin getirilecek sınırlamalar ile bu reklamlarda uyulması gereken usul ve esaslar yönetmelikle belirlenir.
