The administration may, at any stage of the expropriation, waive the expropriation unilaterally, in part or in whole, by decision of the competent authority that took and approved the expropriation decision. However, in case of waiver during the action, the litigation costs and fees, as well as the attorney's fee to be assessed by the court as a lump sum taking into account the labour expended and the importance of the matter, shall be borne by the administration.

MADDE 21 · İdarenin tek taraflı vazgeçmesi
İdare kamulaştırmanın her safhasında kamulaştırma kararı veren ve onaylayan yetkili merciin kararı ile kamulaştırmadan tek taraflı olarak kısmen veya tamamen vazgeçebilir. Şu kadar ki, dava sırasında vazgeçme halinde dava giderleri ile harç, harcanan emek ve işin önemi gözetilerek mahkemece maktuen takdir olunacak avukatlık ücreti idareye yükletilir.
