Article 24: Damage that may be deducted from the expropriation price

Part Five: Damage, Arising Rights and Obligations, Expropriation by Way of Exchange and Urgent Expropriation › Chapter One: Damage

Where the buildings, fixed installations and crops and plantings on immovable property whose expropriation has been abandoned or which has been taken back pursuant to Articles 21, 22 and 23 have been demolished, dismantled or have fallen into ruin, the owner or the owner's heir may, upon taking back the immovable property, request that the difference, calculated according to the value on the date of expropriation, be deducted from the expropriation price that he or she is to pay.

Disputes arising from the application of this Article and of Articles 21, 22 and 23 shall be resolved by the ordinary (civil) courts.

MADDE 24 · Kamulaştırma bedelinden düşülebilecek hasar

21, 22 ve 23 üncü maddeler uyarınca kamulaştırılmasından vazgeçilen veya geri alınan taşınmaz mal üzerindeki bina, sabit tesisler ve ekili dikili şeyler yıkılmış, sökülmüş veya harap olmuş ise, taşınmaz malın geri alınmasında mal sahibi veya mirasçısı, kamulaştırma tarihindeki değerine göre farkının, ödeyeceği kamulaştırma bedelinden düşülmesini isteyebilir.

Bu madde ile 21, 22 ve 23 üncü maddelerin uygulamasından doğacak anlaşmazlıklar adli yargıda çözümlenir.
