Article 58: Compensation for Damage

Part Five: Private Law Consequences of the Restriction of Competition

Those injured as a result of the prevention, distortion or restriction of competition may claim as damages the difference between the price they paid and the price they would have paid had competition not been restricted. Competing undertakings affected by the restriction of competition may claim compensation for all their damages from the undertaking or undertakings restricting competition. In determining the damage, all the profits that the injured undertakings expected to obtain shall be calculated by also taking into account the balance sheets of previous years.

Where the resulting damage arises from an agreement or decision of the parties or from cases involving their gross negligence, the judge may, upon the request of those injured, award compensation in an amount three times the material damage incurred or the profits obtained or likely to be obtained by those who caused the damage.

MADDE 58 · Zararın Tazmini

Rekabetin engellenmesi, bozulması veya kısıtlanması sonucu bundan zarar görenler, ödedikleri bedelle, rekabet sınırlanmasaydı ödemekte olacakları bedel arasındaki farkı zarar olarak talep edebilirler. Rekabetin sınırlanmasından etkilenen rakip teşebbüsler, bütün zararlarının tazminini rekabeti sınırlayan teşebbüs ya da teşebbüslerden talep edebilir. Zararın belirlenmesinde, zarar gören teşebbüslerin elde etmeyi umdukları bütün karlar, geçmiş yıllara ait bilançolar da dikkate alınarak hesaplanır.

Ortaya çıkan zarar, tarafların anlaşması ya da kararı veya ağır ihmalinin olduğu hallerden kaynaklanmaktaysa, hakim, zarar görenlerin talebi üzerine, uğranılan maddi zararın ya da zarara neden olanların elde ettiği veya elde etmesi muhtemel olan karların üç katı oranında tazminata hükmedebilir.
