Article 59: Burden of Proof

Part Five: Private Law Consequences of the Restriction of Competition

Where those injured submit to the judicial authorities evidence giving the impression of the existence of an agreement or of the distortion of competition in the market, in particular the de facto sharing of markets, stability observed in the market price over a period that may be considered long, or price increases made at close intervals by undertakings operating in the market, the burden of proving that the undertakings are not engaged in a concerted practice shall shift to the defendants.

The existence of agreements, decisions and practices restricting competition may be proved by any kind of evidence.

MADDE 59 · İspat Yükü

Zarar görenlerin, bir anlaşmanın varlığı ya da piyasada rekabetin bozulduğu izlenimi veren, özellikle piyasaların fiilen paylaşılması, uzun sayılacak bir süre piyasa fiyatında gözlenen kararlılık, fiyatın piyasada faaliyet gösteren teşebbüslerce birbirine yakın aralıklarla artırıldığı gibi kanıtları yargı organlarına sunmaları halinde, teşebbüslerin uyumlu eylem içinde bulunmadıklarını ispatlama yükü davalılara geçer.

Rekabeti sınırlayıcı anlaşma, karar ve uygulamaların varlığı her türlü delille ispatlanabilir.
