The money, documents and all kinds of property of the Authority shall be deemed State property. The President and members of the Board and the personnel of the Authority shall be deemed public officials with respect to offences committed by them on account of their duties and offences committed against them. Article 104 of the Banking Law No. 5411 dated 19/10/2005 shall apply by analogy with respect to the criminal and civil liability of the President and members of the Board and the personnel of the Authority.

MADDE 60 · Kurumun Para, Evrak ve Malları Üzerinde İşlenen Suçlar

Kurumun para, evrak ve her çeşit malları Devlet malı hükmündedir. Kurul Başkan ve üyeleri ile Kurum personeli, görevleri nedeniyle işledikleri ve kendilerine karşı işlenen suçlar bakımından kamu görevlisi sayılırlar. Kurul Başkan ve üyeleri ile Kurum personelinin cezai ve hukuki sorumluluğuna ilişkin olarak 19/10/2005 tarihli ve 5411 sayılı Bankacılık Kanununun 104 üncü maddesi kıyasen uygulanır.
