Provisional Article 3

Part Six: Final Provisions

Within one year from the date of entry into force of this Law, the Competition Board may, once only, appoint a sufficient number of experts from public or private institutions to work in the Authority, without seeking the conditions in Articles 35 and 36 of the Law.

However, those to be appointed as experts must possess the qualifications listed in subparagraphs (a) and (c) of paragraph 1 of Article 35, have at least five years of experience in their profession, and not have passed the age of forty-one. For those to be appointed as experts from public institutions, it shall additionally be required that they entered their profession through a competitive examination and a qualifying examination.

Until the organisation of the Competition Authority is established, personnel of the related Ministry may be temporarily assigned to carry out the work of the Authority.

GEÇİCİ MADDE 3

Rekabet Kurulu, bu Kanunun yürürlüğe girdiği tarihten itibaren bir yıl içinde, Kanunun 35 ve 36 ncı maddelerindeki şartlar aranmaksızın bir defaya mahsus olmak üzere kamu veya özel kuruluşlardan Kurumda çalışacak yeteri kadar uzman atayabilir.

Şu kadar ki, uzman olarak atanacakların 35 inci maddenin birinci fıkrasının (a) ve (c) bendinde sayılan niteliklere haiz, mesleklerinde en az beş yıllık deneyime sahip, kırkbir yaşından gün almamış olmaları gerekir. Kamu kuruluşlarından uzman olarak atanacaklarda ayrıca mesleklerine yarışma ve yeterlik sınavı ile girmiş olmaları şartı aranır.

Rekabet Kurumu teşkilatı oluşuncaya kadar, Kurumun işlerinin yürütülmesinde ilişkili Bakanlık personeli geçici olarak görevlendirilebilir.
