Article 23: Granting permission to training institutions

Chapter Seven: Mediation Training and Training Institutions

(1) Mediation training shall be provided by the law faculties of universities that have a law faculty, the Union of Turkish Bar Associations and the Justice Academy of Türkiye. These institutions may provide training by obtaining permission from the Ministry. The list of training institutions granted permission shall be published electronically.

(2) Permission shall be applied for in writing. In this application, reasoned information shall be given on the training programme, the number and expertise of the trainers and the sources of financing of the training institution or the training programme.

(3) If it is determined on the basis of the documents submitted with the application that the training will achieve its purpose and that the continuity of the training activity at the training institutions will be ensured, permission valid for a maximum of three years shall be granted to the relevant training institution.

MADDE 23 · Eğitim kuruluşlarına izin verilmesi

(1) Arabuluculuk eğitimi, bünyesinde hukuk fakültesi bulunan üniversitelerin hukuk fakülteleri, Türkiye Barolar Birliği ve Türkiye Adalet Akademisi tarafından verilir. Bu kuruluşlar Bakanlıktan izin alarak eğitim verebilirler. İzin verilen eğitim kuruluşlarının listesi elektronik ortamda yayımlanır.

(2) İzin için yazılı olarak başvurulur. Bu başvuruda eğitim programı, eğiticilerin sayısı ve uzmanlıkları ile eğitim kuruluşu veya eğitim programının finansman kaynakları hakkında gerekçeli bilgi verilir.

(3) Başvuruda sunulan belgelere dayalı olarak, eğitimin amacına ulaşacağı ve eğitim kuruluşlarında eğitim faaliyetinin devamlılığının sağlanacağı tespit edilirse, ilgili eğitim kuruluşuna en çok üç yıl için geçerli olmak üzere izin verilir.
