An employer whose fault is established by a judicial decision in mining workplaces where a fatal occupational accident has occurred shall be prohibited by the court from participating in public tenders for a period of two years, together with the persons listed in the second paragraph of Article 26 of the Public Procurement Contracts Law No. 4735 dated 5/1/2002. A copy of the decision shall be sent to the Public Procurement Authority to be entered in the employer's record and shall be announced on the Authority's website.

MADDE 25/A · Ölümlü iş kazası sebebiyle kamu ihalesinden yasaklama

Ölümlü iş kazası meydana gelen maden işyerlerinde kusuru yargı kararı ile tespit edilen işveren, mahkeme tarafından iki yıl süreyle kamu ihalelerine katılmaktan 5/1/2002 tarihli ve 4735 sayılı Kamu İhale Sözleşmeleri Kanununun 26 ncı maddesinin ikinci fıkrasında sayılanlarla birlikte yasaklanır. Kararın bir örneği işverenin siciline işlenmek üzere Kamu İhale Kurumuna gönderilir ve Kurumun internet sayfasında ilan edilir.
