Article 49: Cases where a foreign State cannot rely on immunity from jurisdiction

Part Two: International Civil Procedure › Chapter One: International Jurisdiction of Turkish Courts

(1) A foreign State shall not be granted immunity from jurisdiction in legal disputes arising from private law relationships.

(2) In such disputes, service may be effected on the diplomatic representatives of the foreign State.

MADDE 49 · Yabancı devletin yargı muafiyetinden yararlanamayacağı hâller

(1) Yabancı devlete, özel hukuk ilişkilerinden doğan hukukî uyuşmazlıklarda yargı muafiyeti tanınmaz.

(2) Bu gibi uyuşmazlıklarda yabancı devletin diplomatik temsilcilerine tebligat yapılabilir.
