Article 47: Jurisdiction agreements and their limits

Part Two: International Civil Procedure › Chapter One: International Jurisdiction of Turkish Courts

(1) Where territorial jurisdiction is not determined on an exclusive basis, the parties may agree that a dispute between them involving a foreign element and arising from obligations shall be heard by a court of a foreign State. The agreement is valid if it is proved by written evidence. The action shall be heard by the competent Turkish court only if the foreign court declines jurisdiction or if no objection to jurisdiction is raised before the Turkish courts.

(2) The jurisdiction of the courts determined in Articles 44, 45 and 46 cannot be excluded by agreement of the parties.

MADDE 47 · Yetki anlaşması ve sınırları

(1) Yer itibariyle yetkinin münhasır yetki esasına göre tayin edilmediği hâllerde, taraflar, aralarındaki yabancılık unsuru taşıyan ve borç ilişkilerinden doğan uyuşmazlığın yabancı bir devletin mahkemesinde görülmesi konusunda anlaşabilirler. Anlaşma, yazılı delille ispat edilmesi hâlinde geçerli olur. Dava, ancak yabancı mahkemenin kendisini yetkisiz sayması veya Türk mahkemelerinde yetki itirazında bulunulmaması hâlinde yetkili Türk mahkemesinde görülür.

(2) 44, 45 ve 46 ncı maddelerde belirlenen mahkemelerin yetkisi tarafların anlaşmasıyla bertaraf edilemez.
