Article 23: I. Against renunciation and excessive restriction

Book One: LAW OF PERSONS › Part One: NATURAL PERSONS › Chapter One: PERSONALITY A. In general

No person may renounce, even in part, his or her legal capacity or capacity to act.

No person may renounce his or her freedoms or restrict them in a manner contrary to law or morality.

The removal, grafting and transplantation of biological materials of human origin is permissible upon written consent. However, a person who has undertaken an obligation to give biological material may not be required to perform it, and no claim for pecuniary or non-pecuniary damages may be made.

MADDE 23 · I. Vazgeçme ve aşırı sınırlamaya karşı

Kimse, hak ve fiil ehliyetlerinden kısmen de olsa vazgeçemez.

Kimse özgürlüklerinden vazgeçemez veya onları hukuka ya da ahlâka aykırı olarak sınırlayamaz.

Yazılı rıza üzerine insan kökenli biyolojik maddelerin alınması, aşılanması ve nakli mümkündür. Ancak, biyolojik madde verme borcu altına girmiş olandan edimini yerine getirmesi istenemez; maddî ve manevî tazminat isteminde bulunulamaz.
