Article 16: 3. Minors and persons under interdiction who have capacity to discern

Book One: LAW OF PERSONS › Part One: NATURAL PERSONS › Chapter One: PERSONALITY A. In general

Minors and persons under interdiction who have the capacity to discern may not incur obligations through their own transactions without the consent of their legal representatives. Such consent is not required for gratuitous acquisitions or for the exercise of strictly personal rights.

Minors and persons under interdiction who have the capacity to discern are liable for their torts.

MADDE 16 · 3. Ayırt etme gücüne sahip küçükler ve kısıtlılar

Ayırt etme gücüne sahip küçükler ve kısıtlılar, yasal temsilcilerinin rızası olmadıkça, kendi işlemleriyle borç altına giremezler. Karşılıksız kazanmada ve kişiye sıkı sıkıya bağlı hakları kullanmada bu rıza gerekli değildir.

Ayırt etme gücüne sahip küçükler ve kısıtlılar haksız fiillerinden sorumludurlar.
