Article 40: 2. In the case of change of sex

Book One: LAW OF PERSONS › Part One: NATURAL PERSONS › Chapter Two: PERSONAL STATUS REGISTER A. In general

A person wishing to change his or her sex may, by applying in person, request the court to grant permission for a change of sex. However, for permission to be granted, the applicant must have completed the age of eighteen and must not be married; furthermore, the applicant must be of transsexual nature and must document, by an official medical board report obtained from (...) a training and research hospital, that the change of sex is mandatory for his or her mental health.

Where it is confirmed by an official medical board report that a sex reassignment operation has been performed in accordance with the purpose of the permission granted and with medical methods, the court shall order that the necessary correction be made in the civil registry.

MADDE 40 · 2. Cinsiyet değişikliğinde

Cinsiyetini değiştirmek isteyen kimse, şahsen başvuruda bulunarak mahkemece cinsiyet değişikliğine izin verilmesini isteyebilir. Ancak, iznin verilebilmesi için, istem sahibinin onsekiz yaşını doldurmuş bulunması ve evli olmaması; ayrıca transseksüel yapıda olup, cinsiyet değişikliğinin ruh sağlığı açısından zorunluluğunu (…) bir eğitim ve araştırma hastanesinden alınacak resmî sağlık kurulu raporuyla belgelemesi şarttır.

Verilen izne bağlı olarak amaç ve tıbbî yöntemlere uygun bir cinsiyet değiştirme ameliyatı gerçekleştirildiğinin resmî sağlık kurulu raporuyla doğrulanması hâlinde, mahkemece nüfus sicilinde gerekli düzeltmenin yapılmasına karar verilir.
