Article 499: B. Surviving spouse

Book Three: LAW OF SUCCESSION › Part One: HEIRS › Chapter One: STATUTORY HEIRS A. Blood relatives

The surviving spouse shall inherit from the deceased, according to the class of heirs with whom he or she inherits, in the following proportions:

1. If inheriting together with the descendants of the deceased, one quarter of the estate,

2. If inheriting together with the class of the deceased's mother and father, one half of the estate,

3. If inheriting together with the grandmothers and grandfathers of the deceased and their children, three quarters of the estate; if there are none of these either, the entire estate shall pass to the spouse.

MADDE 499 · B. Sağ kalan eş

Sağ kalan eş, birlikte bulunduğu zümreye göre mirasbırakana aşağıdaki oranlarda mirasçı olur:

1. Mirasbırakanın altsoyu ile birlikte mirasçı olursa, mirasın dörtte biri,

2. Mirasbırakanın ana ve baba zümresi ile birlikte mirasçı olursa, mirasın yarısı,

3. Mirasbırakanın büyük ana ve büyük babaları ve onların çocukları ile birlikte mirasçı olursa, mirasın dörtte üçü, bunlar da yoksa mirasın tamamı eşe kalır.
