Article 681: I. Joint and several liability

Book Three: LAW OF SUCCESSION › Part Two: DEVOLUTION OF THE ESTATE › Chapter Three: PARTITION OF THE ESTATE › Division Four: COMPLETION AND EFFECT OF PARTITION A. Conclusion of the partition

The heirs shall remain jointly and severally liable with all their assets, even after partition, for debts of the estate to whose division or transfer the creditor has not consented expressly or tacitly.

Joint and several liability shall cease upon the expiry of five years from the date on which the partition took place or, for debts falling due later, from the date on which they fall due.

MADDE 681 · I. Müteselsil sorumluluk

Mirasçılar, bölünmesine veya nakline alacaklı tarafından açık veya örtülü olarak rıza gösterilmemiş olan tereke borçlarından dolayı, paylaşmadan sonra da bütün malvarlıklarıyla müteselsilen sorumludurlar.

Paylaşmanın gerçekleştiği tarihin veya daha sonra yerine getirilecek borçlarda muacceliyet tarihinin üzerinden beş yıl geçmekle teselsül sona erer.
