Article 537: 5. Guarantee by the commission agent

Part Two: Special Obligational Relationships › Chapter Eleven: Commission Contract A. Purchase or sale commission

Except where he or she sells goods on credit without authority, the commission agent shall not be liable for the non-payment by, or the non-performance of other obligations of, the obligors with whom he or she has transacted. However, the commission agent shall be liable if he or she has expressly given a guarantee or if the commercial custom of the place where he or she is located so requires.

A commission agent who gives a guarantee shall be entitled to claim an additional fee therefor.

MADDE 537 · 5. Komisyoncunun garantisi

Yetkisi olmaksızın veresiye mal satması dışında, komisyoncu işlemde bulunduğu borçluların ödememelerinden ve diğer borçlarını ifa etmemelerinden sorumlu olmaz. Ancak, komisyoncu açıkça garanti vermişse veya bulunduğu yerdeki ticari teamül gerektiriyorsa sorumlu olur.

Garanti veren komisyoncunun bundan dolayı ayrıca ücret isteme hakkı vardır.
