Article 543: a. Price and fee

Part Two: Special Obligational Relationships › Chapter Eleven: Commission Contract A. Purchase or sale commission

A commission agent authorised to sell or purchase bills of exchange or other negotiable instruments, or commercial goods, quoted on an exchange or having a market price may, unless otherwise instructed by the principal, sell his or her own goods in place of the goods to be purchased, or purchase for himself or herself the goods to be sold. In these cases, the values at the time when the commission agent transacts with himself or herself shall be taken as the basis; the commission agent shall be entitled, even in these cases, to claim the fee and expenses customary in commission business.

The commission agent must notify the principal of such a transaction on the same day.

In other cases, the provisions on sale shall apply.

MADDE 543 · a. Bedel ve ücret

Borsada kayıtlı veya piyasa fiyatı bulunan kambiyo senetleri veya diğer kıymetli evrakı ya da ticari malları satmaya veya satın almaya yetkili kılınan komisyoncu, vekâlet veren tarafından aksine talimat verilmemişse, satın alacağı mal yerine kendi mallarını satabilir veya satacağı malı kendisi için satın alabilir. Bu hâllerde, komisyoncunun kendisiyle işlem yaptığı andaki değerler esas alınır; komisyoncunun, komisyon işlerinde alışılmış olan ücret ve giderlerini, bu hâllerde bile isteme hakkı vardır.

Komisyoncu, bu tür bir işlemin yapıldığını aynı gün vekâlet verene bildirmek zorundadır.

Diğer hâllerde satış hükümleri uygulanır.
