Article 339: Possession of documents relating to State security

Book Two: Special Provisions › Part Four: Offences against the Nation and the State, and Final Provisions › Chapter Seven: Offences against State Secrets and Espionage

(1) Any person who is caught with documents, or with anything else of that nature, which serve to obtain information that must remain secret for reasons of the security or the internal or external political interests of the State, or matters the disclosure of which is prohibited by the competent authorities and which, by their nature, must remain secret, and for the possession of which no acceptable reason can be shown, shall be sentenced to imprisonment from one year to five years.

(2) Where the act is committed in wartime, the offender shall be sentenced to imprisonment from three years to eight years.

MADDE 339 · Devlet güvenliği ile ilgili belgeleri elinde bulundurma

(1) Devletin güvenliği veya iç veya dış siyasal yararları bakımından gizli kalması gereken bilgileri veya yetkili makamların açıklanmasını yasakladığı ve niteliği bakımından gizli kalması gereken hususları elde etmeye yarayan ve elde bulundurulması için kabul edilebilir bir neden gösterilemeyen belgelerle veya bu nitelikteki herhangi bir şeyle yakalanan kimseye bir yıldan beş yıla kadar hapis cezası verilir.

(2) Fiil, savaş zamanında işlenirse faile üç yıldan sekiz yıla kadar hapis cezası verilir.
