Article 342: Offence against representatives of foreign States

Book Two: Special Provisions › Part Four: Offences against the Nation and the State, and Final Provisions › Chapter Eight: Offences against Relations with Foreign States

(1) With respect to offences committed against them by reason of their duties, representatives of foreign States assigned permanently or temporarily to the Republic of Türkiye and their diplomatic officers, or representatives of international organisations and their officers who are granted diplomatic privileges and immunities, shall be deemed public officials; and persons who commit offences shall be sentenced in accordance with the relevant provisions of this Code.

(2) Where the offence committed is insult, the conduct of an investigation and prosecution shall be subject to the complaint of the victim.

MADDE 342 · Yabancı devlet temsilcilerine karşı suç

(1) Türkiye Cumhuriyetinde sürekli veya geçici olarak görevlendirilmiş yabancı devlet temsilcileri ile bunların diplomasi memurları veya uluslararası kuruluşların temsilcileri ile bunların diplomatik ayrıcalık ve bağışıklık tanınan memurları, kendilerine karşı görevlerinden dolayı işlenen suçlar bakımından, kamu görevlisi kabul edilerek; suç işleyen kişiler hakkında, bu Kanunun ilgili hükümlerine göre cezaya hükmolunur.

(2) İşlenen suç hakaret ise, soruşturma ve kovuşturma yapılması, mağdurun şikayetine bağlıdır.
