Article 33: Persons who are dead but appear alive in the family registers

Part Three: Civil Status Events › Chapter Five: Death and Absence

(1) Death reports concerning persons who have died but who appear alive in the family registers shall be drawn up by the civil registry directorates upon application with a document showing the death, and the necessary action shall be taken. Where no document can be produced, the death report to be drawn up after the truth of the declaration of death has been investigated by the civil registry directorates shall be processed upon the order of the chief local administrative authority.

(2) Added: 19/10/2017, Law No. 7039, Art. 8 Persons in respect of whom no transaction has been carried out for a long time according to the records in the central database and who are likely to be dead given their age shall be identified by the General Directorate. The identified records shall be investigated by the law enforcement forces upon the order of the chief local administrative authority. The deaths of those found to be dead as a result of the investigation shall be registered.

MADDE 33 · Ölü olduğu halde aile kütüklerinde sağ görünenler

(1) Ölmüş olduğu halde aile kütüklerinde sağ görülenlere ait ölüm tutanakları, ölüm olayını gösterir belge ile başvurulması halinde nüfus müdürlüklerince düzenlenir ve gerekli işlem yapılır. Herhangi bir belge ibraz edilememesi durumunda ölüm beyanının doğruluğu nüfus müdürlüklerince tahkik ettirildikten sonra düzenlenecek ölüm tutanağı, mülkî idare amirinin emri ile işleme konulur.

(2) (Ek: 19/10/2017-7039/8 md.) Merkezî veri tabanında yer alan kayıtlara göre uzun süre işlem görmeyen ve yaşı itibarıyla ölü olması muhtemel kişiler Genel Müdürlükçe tespit edilir. Tespit edilen kayıtların araştırılması mülkî idare amirinin emriyle kolluk kuvvetlerine yaptırılır. Araştırma sonucu ölü oldukları tespit edilenlerin ölümleri tescil edilir.
