Article 32: Presumption of death

Part Three: Civil Status Events › Chapter Five: Death and Absence

(1) If a person disappears in circumstances that make his or her death certain, the death shall be entered by drawing up a death report upon the order of the chief local administrative authority of the place applied to, even if the body has not been found.

(2) For action to be taken under this Article, a descendant or ascendant or a sibling of the person presumed dead, or, failing them, his or her heirs, must document the event by applying with a petition, or the competent authorities must notify the situation to the civil registry directorate by an official letter.

(3) If the documents attached to the petition and, where necessary, the investigation to be conducted by the civil registry directorate are deemed sufficient to prove the truth of the event and that the person alleged to have died was present there at the time the event occurred, the death shall be recorded upon the order of the chief local administrative authority.

MADDE 32 · Ölüm karinesi

(1) Bir kimse ölümüne kesin gözle bakılmayı gerektiren durumlar içinde kaybolursa, cesedi bulunamamış olsa bile müracaat edilen yerin mülkî idare amirinin emri ile ölüm tutanağı düzenlenerek ölüm olayı işlenir.

(2) Bu madde uyarınca işlem yapılabilmesi için ölüm karinesi bulunan kişinin alt veya üst soyundan bir kişinin ya da kardeşlerinin, bunlar yoksa mirasçılarının dilekçe ile başvurarak olayı belgelendirmeleri ya da yetkili makamların durumu resmî bir yazı ile nüfus müdürlüğüne bildirmeleri gereklidir.

(3) Dilekçeye ekli belgeler ve gerektiğinde nüfus müdürlüğünce yaptırılacak soruşturma olayın doğruluğunu ve öldüğü iddia edilen kişinin de olayın meydana geldiği sırada orada bulunduğunu kanıtlamaya yeterli görülürse mülkî idare amirinin emri ile ölüm kaydı düşülür.
