Article 44: Persons authorised to obtain civil registry record extracts

Part Six: Disclosure of Information in Civil Registry Records

(1) The following:

a) The Ministry,

b) Foreign missions,

c) The Ministry of National Defence, for conscription procedures,

ç) Judicial authorities,

d) Law enforcement agencies, limited to judicial procedures,

e) Those authorised to conduct marriages, for marriage procedures,

f) Official health institutions, for death procedures,

g) The holders of the record or their spouses, parents, guardians, descendants and ascendants, or those who produce a power of attorney belonging to these persons,

shall be authorised to obtain civil registry record extracts directly from civil registry directorates.

(2) Institutions and legal persons other than those listed in paragraph 1 may obtain a civil registry record extract upon the order of the Ministry or the chief local administrative authority, by applying in writing and clearly stating the reason for the request. The Ministry shall establish an Identity Sharing System to implement the provisions of this Article.

(3) The disclosure of the residence address and other address information shall be subject to the consent of the person.

(4) Third parties other than the persons listed in subparagraph (g) of paragraph 1 may not obtain an extract or information concerning the civil registry record of a person other than information on marital status.

(5) Added: 19/10/2017, Law No. 7039, Art. 10 Persons may, by using secure identity verification tools, query through the e-Government gateway the civil registry record extracts of themselves and their descendants or ascendants, and the residence documents of themselves and their minor children, and may submit the result to the relevant authority in physical or electronic form. Documents obtained through the e-Government gateway shall have the same legal value as other documents obtained from civil registry directorates.

MADDE 44 · Nüfus kayıt örneğini almaya yetkili olanlar

(1) Nüfus kayıt örneklerini;

a) Bakanlık,

b) Dış temsilcilikler,

c) Asker alma işlemleri için Milli Savunma Bakanlığı,

ç) Adlî makamlar,

d) Adlî işlemlerle sınırlı olmak üzere kolluk kuruluşları,

e) Evlenme işlemleri için evlendirme işlemini yapmaya yetkili olanlar,

f) Ölüm işlemleri için resmî sağlık kuruluşları,

g) Kaydın sahipleri veya bunların eşleri ile veli, vasi, alt ve üst soyları ya da bu kişilere ait vekâletnameyi ibraz edenler,

nüfus müdürlüklerinden doğrudan almaya yetkilidirler.

(2) Birinci fıkrada sayılanlar dışında kalan kurumlar ve tüzel kişiler, yazılı olarak başvurmak ve istem nedenini açıkça belirtmek suretiyle Bakanlık veya mülkî idare amirinin emri ile nüfus kayıt örneğini alabilirler. Bakanlık bu madde hükümlerini işletmek üzere Kimlik Paylaşımı Sistemi kurar.

(3) Yerleşim yeri adresi ve diğer adres bilgilerinin verilmesi kişinin rızasına bağlıdır.

(4) Birinci fıkranın (g) bendinde sayılan kişiler dışında kalan üçüncü şahıslar medenî hal bilgisi dışında bir kişinin nüfus kaydına ilişkin örnek veya bilgi alamazlar.

(5) (Ek: 19/10/2017-7039/10 md.) Kişiler; kendileri ve alt ya da üst soylarına ait nüfus kayıt örneklerini, kendileri ve ergin olmayan çocuklarının ise yerleşim yeri belgelerini, güvenli kimlik doğrulama araçlarını kullanarak e-Devlet kapısı üzerinden sorgulayabilir, sonucu fiziki veya elektronik ortamda merciine verebilirler. E-Devlet kapısı üzerinden alınan belgeler, nüfus müdürlüklerinden alınmış diğer belgelerle aynı hukuki değere sahiptir.
