Article 187: Subject of proof

Part Four: Proof and Evidence › Chapter One: General Provisions

(1) The subject of proof consists of the disputed facts on which the parties have not agreed and which may be material to the resolution of the dispute, and evidence shall be indicated for the proof of these facts.

(2) Facts of common knowledge and admitted facts shall not be deemed disputed.

MADDE 187 · İspatın konusu

(1) İspatın konusunu tarafların üzerinde anlaşamadıkları ve uyuşmazlığın çözümünde etkili olabilecek çekişmeli vakıalar oluşturur ve bu vakıaların ispatı için delil gösterilir.

(2) Herkesçe bilinen vakıalarla, ikrar edilmiş vakıalar çekişmeli sayılmaz.
