Article 258: Time and form of the oath

Part Four: Proof and Evidence › Chapter Four: Witnesses

(1) The oath shall be taken before the witness is heard.

(2) While the oath is being taken, everyone present, including the judge, shall stand up.

(3) The judge asks the witness: "Do you swear on your honour, your dignity and all the beliefs and values you hold sacred that the answers you will give to the questions to be put to you in your capacity as a witness will not be contrary to the truth and that you will conceal nothing of what you know?" The oath shall be deemed taken when the witness replies: "I swear on my honour, my dignity and all the beliefs and values I hold sacred that I will answer the questions to be put to me truthfully, concealing nothing."

MADDE 258 · Yeminin zamanı ve şekli

(1) Yemin, tanığın dinlenilmesinden önce eda edilir.

(2) Yemin eda edilirken, hâkim de dâhil olmak üzere hazır bulunan herkes ayağa kalkar.

(3) Hâkim tanığa, “Tanık sıfatıyla sorulacak sorulara vereceğiniz cevapların gerçeğe aykırı olmayacağına ve bilginizden hiçbir şey saklamayacağınıza namusunuz, şerefiniz ve kutsal saydığınız bütün inanç ve değerler üzerine yemin ediyor musunuz?” diye sorar. Tanık da cevaben, “Sorulacak sorulara, hiçbir şey saklamadan doğru cevap vereceğime namusum, şerefim ve kutsal saydığım bütün inanç ve değerlerim üzerine yemin ediyorum.” demekle yemin eda edilmiş sayılır.
