Article 263: Use of interpreters and experts

Part Four: Proof and Evidence › Chapter Four: Witnesses

(1) If the witness does not know Turkish, the witness shall be heard through an interpreter.

(2) If the witness is deaf and mute and can read and write, the questions shall be communicated to him or her in writing and his or her answers shall be taken down in writing; if he or she cannot read and write, the judge shall hear the witness with the assistance of an expert who understands sign language.

MADDE 263 · Tercüman ve bilirkişi kullanılması

(1) Tanık Türkçe bilmezse tercümanla dinlenir.

(2) Tanık, sağır ve dilsiz olup okuma ve yazmayı biliyorsa, sorular kendisine yazılı olarak bildirilir ve cevapları yazdırılır; okuma ve yazma bilmediği takdirde, hâkim, kendisini işaret dilinden anlayan bilirkişi yardımıyla dinler.
