Article 14: III. Prohibition of abuse of fundamental rights and freedoms

PART TWO: FUNDAMENTAL RIGHTS AND DUTIES › CHAPTER ONE: General Provisions

None of the rights and freedoms embodied in the Constitution shall be exercised in the form of activities aiming to violate the indivisible integrity of the State with its territory and nation, and to abolish the democratic and secular Republic based on human rights.

No provision of the Constitution shall be interpreted in a manner that would enable the State or individuals to engage in an activity aimed at destroying the fundamental rights and freedoms recognised by the Constitution or at restricting them more extensively than stated in the Constitution.

The sanctions to be applied against those who perpetrate activities contrary to these provisions shall be regulated by law.

MADDE 14 · III. Temel hak ve hürriyetlerin kötüye kullanılamaması

Anayasada yer alan hak ve hürriyetlerden hiçbiri, Devletin ülkesi ve milletiyle bölünmez bütünlüğünü bozmayı ve insan haklarına dayanan demokratik ve lâik Cumhuriyeti ortadan kaldırmayı amaçlayan faaliyetler biçiminde kullanılamaz.

Anayasa hükümlerinden hiçbiri, Devlete veya kişilere, Anayasayla tanınan temel hak ve hürriyetlerin yok edilmesini veya Anayasada belirtilenden daha geniş şekilde sınırlandırılmasını amaçlayan bir faaliyette bulunmayı mümkün kılacak şekilde yorumlanamaz.

Bu hükümlere aykırı faaliyette bulunanlar hakkında uygulanacak müeyyideler, kanunla düzenlenir.
