Article 7: Unsolicited goods or services

Part Two: General Principles

(1) Where unsolicited goods are sent or unsolicited services are provided, no right may be asserted against the consumer. In such cases, the consumer's silence or the consumer's use of the goods or services may not be interpreted as a declaration of acceptance for the conclusion of a contract. The consumer shall have no obligation to return or keep the goods.

(2) A person who claims that goods or services were ordered shall bear the burden of proving that claim.

MADDE 7 · Sipariş edilmeyen mal veya hizmetler

(1) Sipariş edilmeyen malların gönderilmesi ya da hizmetlerin sunulması durumunda, tüketiciye karşı herhangi bir hak ileri sürülemez. Bu hâllerde, tüketicinin sessiz kalması ya da mal veya hizmeti kullanmış olması, sözleşmenin kurulmasına yönelik kabul beyanı olarak yorumlanamaz. Tüketicinin malı geri göndermek veya muhafaza etmek gibi bir yükümlülüğü yoktur.

(2) Bir mal veya hizmetin sipariş edildiğini iddia eden bu iddiasını ispatla yükümlüdür.
