Article 4: Fundamental principles

Part Two: General Principles

(1) Contracts and information that are required under this Law to be drawn up in writing shall be drawn up in a font size of at least twelve points, in an intelligible language, in a clear, plain and legible manner, and a copy thereof shall be given to the consumer on paper or by means of a durable data medium. Where one or more of the terms required to be contained in the contract are absent, the deficiency shall not affect the validity of the contract. Such deficiency shall be remedied immediately by the party drawing up the contract.

(2) The conditions provided for in the contract may not be changed to the detriment of the consumer during the term of the contract.

(3) No additional charge may be demanded from the consumer for performances which the consumer rightfully expects to be rendered within the scope of the goods or services offered to him and which fall within the legal obligations of the party drawing up the contract, nor for expenses incurred by the party drawing up the contract in its own interest. As regards products or services offered to consumers by banks, financial institutions extending consumer credit and card issuing institutions, all types of fees, commissions and expenses to be charged to the consumer other than interest, and the procedures and principles relating thereto, shall be determined by the Central Bank of the Republic of Türkiye, after obtaining the opinion of the Ministry, in accordance with the spirit of this Law and in a manner protecting the consumer.

(4) Information concerning all fees and expenses to be demanded from the consumer pursuant to contracts regulated by this Law must be given to the consumer in writing on paper as an annex to the contract. In contracts concluded by means of distance communication, such information shall be given in a manner appropriate to the distance communication means used. The burden of proving that such information has been given to the consumer lies with the party drawing up the contract.

(5) In respect of transactions entered into by the consumer, promissory notes having the nature of negotiable instruments may be issued only in registered form and separately for each instalment payment. Promissory notes issued in breach of the provisions of this paragraph shall be invalid with respect to the consumer.

(6) In consumer transactions, personal guarantees taken in return for the consumer's performances shall be deemed ordinary suretyship under whatever name they may be given. Personal guarantees given by the other party in respect of the consumer's receivables shall be deemed joint and several suretyship, unless otherwise provided in other laws.

(7) Compound interest shall not be applied in consumer transactions, including in the event of default.

(8) This Law also covers participation banks with respect to all its provisions. Application shall be made by taking profit share into account.

MADDE 4 · Temel ilkeler

(1) Bu Kanunda yazılı olarak düzenlenmesi öngörülen sözleşmeler ile bilgilendirmeler en az on iki punto büyüklüğünde, anlaşılabilir bir dilde, açık, sade ve okunabilir bir şekilde düzenlenir ve bunların bir nüshası kâğıt üzerinde veya kalıcı veri saklayıcısı ile tüketiciye verilir. Sözleşmede bulunması gereken şartlardan bir veya birkaçının bulunmaması durumunda, eksiklik sözleşmenin geçerliliğini etkilemez. Bu eksiklik sözleşmeyi düzenleyen tarafından derhâl giderilir.

(2) Sözleşmede öngörülen koşullar, sözleşme süresi içinde tüketici aleyhine değiştirilemez.

(3) Tüketiciden; kendisine sunulan mal veya hizmet kapsamında haklı olarak yapılmasını beklediği ve sözleşmeyi düzenleyenin yasal yükümlülükleri arasında yer alan edimler ile sözleşmeyi düzenleyenin kendi menfaati doğrultusunda yapmış olduğu masraflar için ek bir bedel talep edilemez. Bankalar, tüketici kredisi veren finansal kuruluşlar ve kart çıkaran kuruluşlar tarafından tüketiciye sunulan ürün veya hizmetlerde ise tüketiciden faiz dışında alınacak her türlü ücret, komisyon ve masraf türleri ile bunlara ilişkin usul ve esaslar Bakanlığın görüşü alınarak bu Kanunun ruhuna uygun olarak ve tüketiciyi koruyacak şekilde Türkiye Cumhuriyet Merkez Bankası tarafından belirlenir.

(4) Bu Kanunda düzenlenen sözleşmelere istinaden tüketiciden talep edilecek her türlü ücret ve masrafa ilişkin bilgilerin, sözleşmenin eki olarak kâğıt üzerinde yazılı şekilde tüketiciye verilmesi zorunludur. Uzaktan iletişim aracıyla kurulan sözleşmelerde ise, bu bilgiler kullanılan uzaktan iletişim aracına uygun şekilde verilir. Bu bilgilerin tüketiciye verildiğinin ispatı sözleşmeyi düzenleyene aittir.

(5) Tüketicinin yapmış olduğu işlemler nedeniyle kıymetli evrak niteliğinde sadece nama yazılı ve her bir taksit ödemesi için ayrı ayrı olacak şekilde senet düzenlenebilir. Bu fıkra hükümlerine aykırı olarak düzenlenen senetler tüketici yönünden geçersizdir.

(6) Tüketici işlemlerinde, tüketicinin edimlerine karşılık olarak alınan şahsi teminatlar, her ne isim altında olursa olsun adi kefalet sayılır. Tüketicinin alacaklarına ilişkin karşı tarafça verilen şahsi teminatlar diğer kanunlarda aksine hüküm bulunmadıkça müteselsil kefalet sayılır.

(7) Temerrüt hâli de dâhil olmak üzere, tüketici işlemlerinde bileşik faiz uygulanmaz.

(8) Bu Kanun tüm düzenlemeleri yönünden katılım bankalarını da kapsar. Uygulama, kâr payı dikkate alınarak yapılır.
