Article 62: Conditional refugee

Part Three: International Protection › Chapter One: Types of International Protection, Exclusion from International Protection

(1) A foreigner who, owing to well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion as a result of events occurring outside European countries, is outside the country of his or her nationality and is unable or, owing to such fear, unwilling to avail himself or herself of the protection of that country, or a stateless person who, as a result of such events, is outside the country of his or her former habitual residence and is unable or, owing to such fear, unwilling to return to it, shall be granted conditional refugee status following status determination proceedings. A conditional refugee shall be permitted to remain in Türkiye until he or she is resettled in a third country.

MADDE 62 · Şartlı mülteci

(1) Avrupa ülkeleri dışında meydana gelen olaylar sebebiyle; ırkı, dini, tabiiyeti, belli bir toplumsal gruba mensubiyeti veya siyasi düşüncelerinden dolayı zulme uğrayacağından haklı sebeplerle korktuğu için vatandaşı olduğu ülkenin dışında bulunan ve bu ülkenin korumasından yararlanamayan, ya da söz konusu korku nedeniyle yararlanmak istemeyen yabancıya veya bu tür olaylar sonucu önceden yaşadığı ikamet ülkesinin dışında bulunan, oraya dönemeyen veya söz konusu korku nedeniyle dönmek istemeyen vatansız kişiye statü belirleme işlemleri sonrasında şartlı mülteci statüsü verilir. Üçüncü ülkeye yerleştirilinceye kadar, şartlı mültecinin Türkiye’de kalmasına izin verilir.
