Article 4: Confidentiality

Chapter Two: Fundamental Principles of Mediation

(1) Unless otherwise agreed by the parties, the mediator shall be obliged to keep confidential the information and documents submitted to him or her or otherwise obtained within the framework of the mediation activity, as well as other records.

(2) Unless otherwise agreed, the parties and other persons participating in the discussions shall also be obliged to comply with confidentiality in this regard.

MADDE 4 · Gizlilik

(1) Taraflarca aksi kararlaştırılmadıkça arabulucu, arabuluculuk faaliyeti çerçevesinde kendisine sunulan veya diğer bir şekilde elde ettiği bilgi ve belgeler ile diğer kayıtları gizli tutmakla yükümlüdür.

(2) Aksi kararlaştırılmadıkça taraflar ve görüşmelere katılan diğer kişiler de bu konudaki gizliliğe uymak zorundadırlar.
