Chapter Two: Fundamental Principles of Mediation
(1) The parties are free to apply to a mediator, to continue, to conclude or to withdraw from the process. Added sentence: 6/12/2018, Law No. 7155, Art. 22 However, the provision of Article 18/A on mediation as a precondition to filing an action is reserved.
(2) The parties shall have equal rights both when applying to a mediator and throughout the entire process.

MADDE 3 · İradi olma ve eşitlik
(1) Taraflar, arabulucuya başvurmak, süreci devam ettirmek, sonuçlandırmak veya bu süreçten vazgeçmek konusunda serbesttirler. (Ek cümle:6/12/2018-7155/22 md.) Şu kadar ki dava şartı olarak arabuluculuğa ilişkin 18/A maddesi hükmü saklıdır.
(2) Taraflar, gerek arabulucuya başvururken gerekse tüm süreç boyunca eşit haklara sahiptirler.
