Article 620: I. Entry in the inventory

Book Three: LAW OF SUCCESSION › Part Two: DEVOLUTION OF THE ESTATE › Chapter Two: EFFECTS OF THE DEVOLUTION OF THE ESTATE › Division Three: OFFICIAL INVENTORY

The official inventory shall be drawn up by the civil court of peace; the assets and liabilities of the estate shall be entered in this inventory with their appraised values.

Any person having information about the financial situation of the deceased shall be obliged to provide the information requested by the civil court of peace. Persons who fail to provide information without just cause, or who provide incorrect or incomplete information, shall be obliged to compensate the heirs, legatees or third parties for the resulting damage.

The heirs shall in particular be obliged to notify the civil court of peace of the debts of the deceased known to them.

The manner in which the official inventory is to be kept shall be governed by a regulation issued by the President of the Republic.

MADDE 620 · I. Deftere geçirme

Resmî defter, sulh mahkemesi tarafından düzenlenir; bu deftere terekeye ait aktif ve pasifler takdir edilen değerleriyle yazılır.

Mirasbırakanın malî durumu hakkında bilgi sahibi olan herkes, sulh mahkemesi tarafından istenilen bilgiyi vermekle yükümlüdür. Haklı bir sebep olmaksızın bilgi vermeyenler veya yanlış ya da eksik bilgi verenler, bundan doğacak zararları mirasçılara, vasiyet alacaklılarına veya üçüncü kişilere tazminle yükümlüdürler.

Mirasçılar, özellikle mirasbırakanın kendilerince bilinen borçlarını sulh mahkemesine bildirmek zorundadırlar.

Resmî defterin nasıl tutulacağı Cumhurbaşkanınca çıkarılan yönetmelikle düzenlenir.
