Article 628: 1. Liability for entries in the inventory

Book Three: LAW OF SUCCESSION › Part Two: DEVOLUTION OF THE ESTATE › Chapter Two: EFFECTS OF THE DEVOLUTION OF THE ESTATE › Division Three: OFFICIAL INVENTORY

An estate accepted subject to the official inventory passes to the heir only with the debts entered in the inventory.

Such devolution of the estate takes effect from the date on which the succession opened.

The heir shall be liable for the debts of the deceased entered in the inventory both with the estate assets and with his own assets.

MADDE 628 · 1. Deftere yazılanlardan sorumluluk

Resmî deftere göre kabul edilen miras, mirasçıya sadece deftere yazılmış borçlarla geçer.

Bu suretle mirasın geçmesi, mirasın açıldığı tarihten başlayarak hüküm ifade eder.

Mirasçı, mirasbırakanın deftere yazılmış olan borçlarından hem tereke malları, hem kendi malvarlığı ile sorumludur.
