Article 786: 1. In general

Book Four: LAW OF PROPERTY › Part Two: LIMITED RIGHTS IN REM › Chapter One: SERVITUDES AND LAND CHARGES › Division One: SERVITUDES IN FAVOUR OF IMMOVABLE PROPERTY

The holder of a servitude may take the measures necessary for the preservation and exercise of his or her right; however, he or she shall be obliged to exercise his or her right in a manner that causes the least damage to the owner of the servient immovable property.

The owner of the servient immovable property may not engage in any conduct that would prevent or impede the exercise of the servitude.

MADDE 786 · 1. Genel olarak

İrtifak hakkı sahibi, hakkının korunması ve kullanılması için gerekli olan önlemleri alabilir; ancak, hakkını yüklü taşınmazın malikine en az zarar verecek biçimde kullanmak zorundadır.

Yüklü taşınmazın maliki, irtifak hakkının kullanılmasını engelleyecek ya da zorlaştıracak davranışlarda bulunamaz.
