Article 791: 1. Relocation of the place to which the servitude relates

Book Four: LAW OF PROPERTY › Part Two: LIMITED RIGHTS IN REM › Chapter One: SERVITUDES AND LAND CHARGES › Division One: SERVITUDES IN FAVOUR OF IMMOVABLE PROPERTY

Where a servitude has been established on condition that only a certain part of the servient immovable property is used, the owner of that immovable property may, provided that he or she proves his or her interest and bears the costs, demand that the servitude be relocated to another part of the immovable property in a manner that does not impede the exercise of the right.

The owner of the servient immovable property may exercise this power even if the place where the servitude is to be exercised is specified in the land register.

In the relocation of conduits from one place to another, the rules of neighbour law shall also be taken into account.

MADDE 791 · 1. İrtifak hakkının ilişkin olduğu yerin değiştirilmesi

İrtifak hakkı yüklü taşınmazın yalnız belli bir kısmının kullanılması koşuluyla kurulmuşsa, bu taşınmazın maliki, menfaatini ispat etmek ve giderleri üstlenmek kaydıyla; irtifakın, hakkın kullanılmasını güçleştirmeyecek biçimde taşınmazın başka bir yerine naklini isteyebilir.

İrtifak hakkının kullanılacağı yer tapu kütüğünde belirtilmiş olsa bile yüklü taşınmaz maliki bu yetkiyi kullanabilir.

Mecraların bir yerden başka bir yere naklinde komşuluk hukuku kuralları da göz önünde tutulur.
