Article 87: I. Automatic termination

Book One: LAW OF PERSONS › Part Two: LEGAL PERSONS › Chapter Two: ASSOCIATIONS A. Establishment

Associations shall terminate automatically in the following cases:

1. Achievement of the purpose, the purpose becoming impossible to achieve, or expiry of the term,

2. The first general assembly meeting not having been held within the period prescribed by law and the mandatory organs not having been formed,

3. Insolvency,

4. The formation of the board of directors in accordance with the bylaws having become impossible,

5. Failure to hold the ordinary general assembly meeting twice in succession.

Any interested party may request the judge of the civil court of peace to establish that the association has terminated automatically.

MADDE 87 · I. Kendiliğinden

Dernekler, aşağıdaki hâllerde kendiliğinden sona erer:

1. Amacın gerçekleşmesi, gerçekleşmesinin olanaksız hâle gelmesi veya sürenin sona ermesi,

2. İlk genel kurul toplantısının kanunda öngörülen sürede yapılmamış ve zorunlu organların oluşturulmamış olması,

3. Borç ödemede acze düşmüş olması,

4. Tüzük gereğince yönetim kurulunun oluşturulmasının olanaksız hâle gelmesi,

5. Olağan genel kurul toplantısının iki defa üst üste yapılamaması.

Her ilgili, sulh hâkiminden, derneğin kendiliğinden sonra erdiğinin tespitini isteyebilir.
