Article 473: 3. Commencement and conduct of the work

Part Two: Special Obligational Relationships › Chapter Seven: Contract for Work

If the contractor fails to begin the work in good time, or delays the work in breach of the terms of the contract, or if, owing to a delay arising from a cause not attributable to the employer, it becomes clearly apparent that by all estimates the contractor will be unable to complete the work by the agreed time, the employer may withdraw from the contract without being obliged to wait for the date set for delivery.

If, during the making of the work, it is clearly evident that the work will be made defective or contrary to the contract through the fault of the contractor, the employer may, within an appropriate time limit which he grants or causes to be granted in order to prevent this, give the contractor notice to remedy the defect or non-conformity, failing which the repair or the continuation of the work will be entrusted to a third party at the contractor's own risk and expense.

MADDE 473 · 3. İşe başlama ve yürütme

Yüklenicinin işe zamanında başlamaması veya sözleşme hükümlerine aykırı olarak işi geciktirmesi ya da işsahibine yüklenemeyecek bir sebeple ortaya çıkan gecikme yüzünden bütün tahminlere göre yüklenicinin işi kararlaştırılan zamanda bitiremeyeceği açıkça anlaşılırsa, işsahibi teslim için belirlenen günü beklemek zorunda olmaksızın sözleşmeden dönebilir.

Meydana getirilmesi sırasında, eserin yüklenicinin kusuru yüzünden ayıplı veya sözleşmeye aykırı olarak meydana getirileceği açıkça görülüyorsa, işsahibi bunu önlemek üzere vereceği veya verdireceği uygun bir süre içinde yükleniciye, ayıbın veya aykırılığın giderilmesi; aksi takdirde hasar ve masrafları kendisine ait olmak üzere, onarımın veya işe devamın bir üçüncü kişiye verileceği konusunda ihtarda bulunabilir.
