Part One: Tax Liability › Chapter Two: Transitional Provisions

(1) To be applied until 31/12/2045, value added tax borne, as of the date on which this article enters into force, in connection with construction works relating to nuclear power plant investments within the scope of the investment incentive certificates of taxpayers that have obtained a preliminary licence and/or licence to engage in electricity generation activities at nuclear power plants, and which cannot be offset by way of deduction as of the six-month periods of the calendar year, shall be refunded to the taxpayer if requested within one year following the six-month periods.

(2) To be applied until 31/12/2045, deliveries of machinery and equipment to be made in relation to nuclear power plant investments within the scope of the investment incentive certificates of taxpayers that have obtained a preliminary licence and/or licence to engage in electricity generation activities at nuclear power plants shall be exempt from value added tax. Taxes borne in connection with deliveries made within this scope shall be deducted from the tax calculated on taxable transactions. Taxes that cannot be offset by way of deduction shall be refunded, pursuant to Article 32, upon the request of the taxpayer carrying out transactions within the scope of the exemption.

(3) Where the investment is not completed, the taxes not collected in due time or refunded under this article shall be collected from the investor together with late payment interest, with a tax loss penalty applied. The limitation period for these taxes and for tax penalties shall begin from the beginning of the calendar year following the date on which the circumstance requiring the assessment of the tax or the imposition of the penalty occurs.

(4) The President of the Republic is authorised to extend the periods specified in the first and second paragraphs until 31/12/2050; the Ministry of Treasury and Finance is authorised to determine the procedures and principles relating to the implementation of this article.

GEÇİCİ MADDE 47

(1) 31/12/2045 tarihine kadar uygulanmak üzere, nükleer enerji santrallerinde elektrik enerjisi üretimi faaliyetinde bulunmak için önlisans ve/veya lisans alan mükelleflerin yatırım teşvik belgeleri kapsamında nükleer enerji santralleri yatırımlarına ilişkin inşaat işleri nedeniyle bu maddenin yürürlüğe girdiği tarihten itibaren yüklenilen ve takvim yılının altı aylık dönemleri itibarıyla indirim yoluyla telafi edilemeyen katma değer vergisi, altı aylık dönemleri izleyen bir yıl içinde talep edilmesi halinde mükellefe iade edilir.

(2) 31/12/2045 tarihine kadar uygulanmak üzere, nükleer enerji santrallerinde elektrik enerjisi üretimi faaliyetinde bulunmak için önlisans ve/veya lisans alan mükelleflerin yatırım teşvik belgeleri kapsamında nükleer enerji santralleri yatırımlarına ilişkin yapılacak makine ve teçhizat teslimleri katma değer vergisinden müstesnadır. Bu kapsamda yapılan teslimler nedeniyle yüklenilen vergiler, vergiye tabi işlemler üzerinden hesaplanan vergiden indirilir. İndirim yoluyla telafi edilemeyen vergiler, 32 nci madde hükmü uyarınca istisna kapsamında işlem yapan mükellefin talebi üzerine iade edilir.

(3) Yatırımın tamamlanmaması halinde, bu madde kapsamında zamanında alınmayan veya iade edilen vergiler yatırımcıdan, vergi ziyaı cezası uygulanarak gecikme faizi ile birlikte tahsil edilir. Bu vergiler ile vergi cezalarında zamanaşımı, verginin tarhını veya cezanın kesilmesini gerektiren durumun meydana geldiği tarihi takip eden takvim yılının başından itibaren başlar.

(4) Cumhurbaşkanı birinci ve ikinci fıkrada yer alan süreleri 31/12/2050 tarihine kadar uzatmaya; Hazine ve Maliye Bakanlığı bu maddenin uygulanmasına ilişkin usul ve esasları belirlemeye yetkilidir.
